FULUS AND OTHER MONIES.فلوس اور زر ---


ABSTRACT.
At the advent of Islam,the money system was comprised of three coins,namely gold(Dinar),silver(Dirham) and copper(Fulus). The copper coins were known as fulus.The intrinsic value on the fulus was only a fraction of their face value. What is now called, the silver and gold were full bodied monies, whereas the fulus were a fiat money, having a face value in excess of their intrinsic value. The Dinar is only mentioned once in the Holly Koran in Surah 3:75, whereas it frequently occurs in books of Law. Similarly the Dirham is mentioned once in the Holly  in Surah-12:20. The Dinar and Dirham were weight and coins. The Business men in Mecca used the bullion/pieces of gold and silver instead   of coins  with  their standard  face value. Although the Islamic scholars had mentioned, that it was difficult to divide a dinar of gold in many small piece, hence we find a tradition in  Alsunan of Abudawd-volume-2  bearing No.186. The Dinar of Gold could be divided in so many pieces and if the aggregate of these pieces was found equal to a Dinar it was being accepted in the market as a Dinar. Hadrat Ali (A.S) had purchased the meat after taking two carats from a dinar. But it was ,perhaps difficult and not impossible to divide a dinar in some pieces . From this tradition it seems that the fulus were not either prevalent or these were not being accepted frequently there at that times.

It is said by the scholars that -the"fulus" were a form of sub-money used only to make payments of the fractions of a silver coin because it was not easy to break one silver dirham into two equal parts for making payment of half dirham nor it was easy for the government or the money changers to issue smaller silver coins to facilitate such fractional payments. Before, when the fulus were not in use the nominal transactions were made with eggs and wheat etc. But after that when the fulus were struck, these had been used firstly for smallest transactions,because unlike the full-bodied money,fulus afforded great transcriptional convenience. They were minted in abundance and were quite useful in small  exchanges. Their acceptability was not due to either their intrinsic value or their being a representative money. It was purely due to trust and confidence that these were acceptable in the market.

 In the early days of Islam the Scholars(Fuqha) had not accepted  the fulus as "Money" but goods ,as in the statements of Imam Abu Hanifa(R.A), Imam Yousaf(R.A) and according to a state,ment of Imam Malik(R.A). In the other statement of Imam Malik،  the fulus ہhas the status of "Money" because of(سد الزرایع) ,closing of the means, so that the ihkam(Commands of Lawgiver) regarding Zakah and Riba/usury may not be suspended. Some other Fuqha given the status to fulus as "Makroh"-DISAPPROVED-permissible but unhappily. Now the fulus are considered "like  or near to paper money" as both are the substitutes of money " Gold and Silver" full-bodied money. But, in facts, although the fulus and paper monies have taken the place of full-bodied monies but these are not performing the same function ,keeping in view the Islamic injunctions and the need in the prevailing monetary systems due to most of the deficiencies which they have. The inflation and need of the indexation are worth-mentioning in these deficiencies.The paper money has no intrinsic value. We have seen  instances in the history,for example at the time of "fall of Kuwait"the precious Dinar of the Kuwait has lost its total value. If there were gold and silver dinars/dirhams, they could keep their intrinsic values.

FULUS.
It is said that the name of fulus comes from"follis"(plural)"folles, a coin made of bronze from the Roman and Byzantine tradition. There are so many statements about its basic name. According to the" Lisan al Arab by Ibn Manzor,"fulus" is plural of "fils" --words- "aflas" and" talfees" had been derived from this word. Aflas- means poverty and- talfees- means" bankruptcy" which is declared by the competent authority for a person. Further it is in the meaning of paisah. Dr.Waqar Masood Khan writes- The three coins that prevailed in the Islamic World were dinar,dirham and fulus. The last one was made of copper, and was equivalent of bronze of the Greek system.

Let us briefly survey the main aspects of how the money has evolved to its present form. Our interest would be to understand the monetary system that existed at the time of the advent of Islam. As we shall see, the system that prevailed at the time of the advent of Islam had essentially evolved by the year 700 BC and survived until the 19th century. This system is largely the system of coins: gold, silver and copper. The main features of this system were (EncyclopediBritannica"Money)
(1).It dates back to Greece, where the earliest coinage is attributed to King Croesus(560-564 BC) of Lydia(Asia Minor or Turkey), the earliest man known for his fabulous wealth. Gold(denarium), silver(drachm, tetradrachm(4 drachm),obol(1/6 of drachm) and bronze (chalcoi was denominated in obol) came successively in use.

(2).This system was supported by an elaborated system of money changers and rates of exchanges across different types of coinage. The money changers were licensed by city states and they charged commission for their services. They performed two functions, namely(1) changing foreign coins into local coins, and(2) from one metal to another
.
(3)The work of money changer was made efficient and was regulated by another service provider, who was officially appointed, and was called dokimasters or coin-validator, whose job was to verify the contents of  various coins and prevent forgeries.

(4) Hellenistics expansion brought large geographical area within its influence where coins were circulated and made it possible for other civilizations, most notable Iranians, to engage in coinage. The notion of Royal coinage emerged during this period.

(5) The rise of Rome brought an end to the Greek coinage.Initially, the Romans, in their characteristic style of conquests left the Greek coins continue to float but under their authority. After the establishment of monarchical power by Augustus, the first Roman Emperor(31 BC-14 AD), the imperial portrait appeared on almost all the coinage produced throughout the Roman empire.

(6)At the advent of Islam, it was the Roman-Sassanian monetary system that prevailed in Arabian(Drachma came from Iran and Dinar and Bronze came from Rome).The Prophet (peace be upon him) tacitly allowed this system to continue.

(7)This continued to remain so until, Abd al Malik ibn Marwan introduced the first Islamic coins.(A statement related to Hadrat Umar r.a.t.a, that in 17th A.H the fulus were struck, but these were imitation of the current fulus) This marked a significant break from pictorial punches to calligraphic.

(8)It is said that of the two things a Muslim ruler used to announce his sovereignty with were the mention of his name in the Friday sermon and striking of coins-sikkah.

(9) Orhan(r.1326-1360) was the first Ottman ruler who engraved coins in his own name.

The intrinsic value of the fulus-made out of copper etc-was only a fraction of their face value. In this respect, while the silver and gold were,what is now called,full bodied monies,the fulus were a fiat money having a face value in excess of their intrinsic value.

In the HISTORY OF FULUS it is said that firstly these were struck in the days of Hadrat Umar the second Caliph (r.643-44). Before the fulus the people were making the minor transactions with eggs and wheat etc,because these had been used as(Thuman) price..

The fulus were minted in abundance and were quite useful in small exchanges in which the use of gold and silver coins would have been a problem on account of divisibility. their acceptability was not due to either their intrinsic value or their being a representative money. It was purely due to trust and confidence that these were acceptable in the market.Obviously, this must have come about after a long process which must have its pitfalls also. 
Some of the problems with fulus are worth mentioning.


(1)Fulus had a fairly limited geographical acceptability;


(2)There was no single standard regulating their size,shape,denomination or wight of the coin;


(3)Many kinds of fulus circulated side by side,with varying degrees of acceptability and values in exchange;


(4)There was no control over the supplies of the coins;and


(5)Fulus went out of circulation quite frequently,hence they caused considerable uncertainty about the value of transactions,particularly those based on deferred payments.


It was due to such limitations of fulus that one encounters significant difference in the view of fuqaha, regarding their treatment as money. Two such differences are worth mentioning , as they have important bearing on our final discussion on the subject. First, exchange of similar commodities is prohibited because of riba al-fadl,unless equal quantities and by spot exchange. Gold and silver are among the six commodities enumerated in the famous ahadith on the subject of riba al-fadl.( Ref: from Transition to a Riba free economy-IRI-IIUI-Islamabad)


Now we are writing here two ahadith of the Holly Prophet(peace be upon him) on the subject.
1. From abu Sa'id al -Khudri, who said" the Messenger of Allah(s.a.w.a) said" Do not sell gold for gold except when it is like for like; nor misappropriate on through the other, nor sell silver for silver except like for like; nor misappropriate one through the other, nor sell things that are absent for those that are present.


2.From'Ubadah Ibn Samit who said," The messenger of Allah(s.a.w.a) said:Gold for Gold. silver for silver, wheat for wheat, barley for barley, dates for dates, salt for salt,like for like, in equal weights, from hand to hand. If those species differ, then sell as you like as long as it is from hand to hand"( Ref: p-126-27-Islamic Law of Contracts and Business Transaction IRI)


STATUS OF THE FULUS BEFORE EARLY SCHOLARS OF ISLAM(FUQHA)


Imam Abu Hanifah(d-150 A.H) and Imam Abu Yusu( )"Sheikhain" are of the view that fulus can be particularized, and in this respect these are like good, which can be traded. According these fuquha, have allowed the sale on one fals for two fulus. On the other hand, Imam Muhammad, considering them as absolute currency, at par with gold and silver, would not approve of their exchange.


Secondly, Sheikheen would not approve of fulus as capital for partnership and mudarabah, while Imam Muhammad approves this so long as the fullus in question are in circulation.



 Ironically,despite so many problems and limitations, fulus had all the qualities that will be found in the mode paper currency. 

KINDS OF MONEY(6) NECESSARY GLOSSAY FOR USEFUL CONCEPTS TERM/MEANING.

1. FULL BODIED MONEY; MONEY WHOSE METALLIC CONTENTS HAD A VALUE IN NON-MONETARY USES(SUCH AS IN MAKING ORNAMENTS)EQUAL TO THEIR VALUE IN EXCHANGE.

2. COMMODITY STANDARD. A MONEY SYSTEM THAT IS BASED ON FULL BODIED MONEY. THE FAMOUS GOLD STANDARD WAS AN EXAMPLE OF COMMODITY STANDARD.

3. REPRESENTATIVE FULL BODIED MONEY. A SYSTEM OF TOKEN MONEY THAT HAVE LITTLE INTRINSIC VALUE BUT THAT IS BACKED(CAN BE CONVERTED INTO)A COMMODITY SUCH AS GOLD AND SILVER. THE TOKENS MAY OR MAY BE METALLIC. THE US AND SOME OTHER COUNTRIES USED THIS SYSTEM UNTIL THE MIDDLE OF THE TWENTIETH CENTURY, WHEN GOLD AND SILVER CERTIFICATES WERE ISSUED BY US TREASURY WHICH REPRESENTED THE VALUE OF UNDERLYING METAL AS FIXED BY THE GOVERNMENT.

4. FIAT MONEY: A MONEY THAT HAS LITTLE COMMODITY VALUE COMPARED TO ITS VALUE IN EXCHANGE. THIS MONEY IS ISSUED BY GOVERNMENT,CENTRAL BANK AND OTHER FINANCIAL INSTITUTIONS.

5. FIDUCIARY MONEY SYSTEM :A SYSTEM BASED ON FIAT MONEY.

GOLD STANDARD: A MONEY SYSTEM PREVALENT IN MANY COUNTRIES UNTIL THE EARLY 1970S BUT IS NOW DISCONTINUED UNDER WHICH THE UNITS OF THE CURRENCY OF COUNTRY WERE CONVERTIBLE INTO FIXED AMOUNTS OF GOLD:FIXED PARITY A UNIT OF CURRENCY-DEFINED AND MAINTAINED BY THE CENTRAL BANK AND BACKED BY THE SOVEREIGN GUARANTEE.

فلوس "فلس"کی جمع ہے .اس لفظ کی اصل کے بارے میں مختلف آرا ہیں .بعض  حضرات کی را ے  میں یہ یونانی  لفظ ہے ،جسے عربوں نے معرب  بنا لیا ہے .یہ بھی ممکن ہے کہ اس کے سوا کوئی اور اصل هو .الموسوعة العربية الميسرة  كے مصنفين  اس بارے میں لکھتے ہیں:

یہ تانبے یا پیتل کا سکہ  ہے،جسے عربوں نے بازنطنیوں سے مستعار  لیا ہے ،با زنطینیوں کے ہا ن فلس کے لیے کوئی خاص وزن  مقرر نہیں تھا ،لیکن عربوں نے اس کا وژن کانچ کے ایسے با ٹوں" الصنج کے ساتھ متعین کر دیا ،جنہیں خاص پیمانوں  کے تحت  مقرر کیا گیا تھا .یہ بھی کہا جاتا ہے کہ فلس ایک درہم کے اڑتالیسویں حصے کے برابر ہوتا تھا .

لسان العرب،کے مطابق ،فلوس "فلس "کی جمع ہے،فلس پیسہ کے معنیٰ میں ہے،اسی سے "افلاس "اور "تفلیس "مشتق ہے،افلاس کے معنی غربت کے ہیں ،اور تلفیس کے معنی  ہیں : حاکم کا کسی کو مفلس قرار دینا (زر کا تحقیقی مطالعہ از ڈاکٹر مولانا عصمت اللہ  صاحب )
  
تقی الدین احمد بن علی مقریزی -وفات ٨٤٥ ھ ،اپنی کتاب شذور العقود في ذكر النقود میں فلوس پر بحث کرتے ہونے  لکھتے ہیں:
"ایسے نقود جو اشیا فروخت کا ثمن اور خدمات کی قیمت بن سکتے ہیں وہ صرف سونا اور چاندی ہیں ....لیکن چونکہ بعض  اشیا فروخت اتنی کم قیمت کی ہوتی ہیں کہ انہیں ایک درہم یا اس کے کچھ حصے کےعوض  فروخت نہیں کیا جا سکتا  تھا ،اس لیےانسان کو قدیم اور جدید دور میں سونے اور چاندی کے سوا کسی ایسی چیز کی ضرورت محسوس ہوئی ،جس کے ذریعہ ایسی معمولی قیمت کی اشیا خریدی جا سکیں

 فلوس کے ذریعے کسی اہمیت کی حامل چیز کو نہیں خریدا جاتاتھا،بلکہانہیںصرف گھریلو اخراجات کے لیتے استعمال کیا جاتا 
تھا. .....پھر محمود بن علی استادار ملک ظاھر برقوق کے دور میں فلوس کا استعمال زیادہ هو گیا اور انگریز  پرافٹ کمانے کےلیے تانبا مصر میں لانے لگے. سالہا  سال تک فلوس ڈھلتے رہے اور انگریز مصر کے دراہم اپنے ملک منتقل کرتے رہے، جبکہ اہلیان وطن منافع کمانے  کی غرض سے انہیں داھلتے رہے یہاں تک کہ انکا وجود ناپیدھو گیا اور وہ نایاب ہونےکے قریب هو گنے. اس دور میں فلوس کو اتنا رواج حاصل ہوا کے تمام اشیا فروخت انہیں سے منسوب کی جانے لگیں اور یوں کہا جانے لگا: ایک دینار اتنےفلوس کے عوض  آتا ہے.        ---- خدا کی قسم یہ ایسی بات ہے،جسے زکر کرتے ہونے بھی شرم محسوس ہوتی ہے،کیونکہ یہ قانون فطرت کے خلاف ہے.لیکن کافی عرصے تکانہیں استعمال کرنے کیوجہ سے لوگ ان سے مانوس هو گۓ ہیں کیونکہ انھیں تو اپنےمنافع سےغرضہوتیہے،حالانکہ یہ بڑی افسوس کی بات ہے.(بحوالہ -خرید  و فروخت  محولہ بالا)

امام نووی لکھتے ہیں کہ اگرچہ  یہ بعض شہروں میں بطور ثمن کے استعمال ہوتے ہیں ،لیکن عام طور پر ثمن کی جنس میں سے نہیں ہیں. یہ بت مقریزی کےساتھ بھی کچھ ملتی ہے .
١. جس صورت حال  کے دوران  مصر میں فلوس کا رواج زیادہ هو گیا تھا ،وو ایک مدت تک قائم رہی ،جبکہ مہنگائی کی شدت اور چاندی کی کمیابی کی صورت میں، اس کے افسوس ناک نتائج برآمد ہوےٴ .  

٢. فلوس رواج پانے کے باوجود مقریزی کی نگاہ میں ایسی کم قیمت اشیا کے معا و ضے کی حثیت رکھتے ہیں ،جنہیں درہم یا اس کے کچھ حصے کے عوض   نہیں خریدا جا سکتا ،نیز مقریزی کے بقول انہیں نقدی بھی  نہیں کہا گیا -ان کی را ے میں فلوس کا رواج پانا قانون فطرت کے خلاف ہونے کی وجہ سے شرمناک بات ہے -اس کے ساتھ ساتھ مقریزی فلوس کو صرف تانبے کا  سامان شمار کرتے ہیں ،جس کی قیمت کا تعین اس کی دھات کی قیمت اور ٹکسال میں اٹھنے والے اخراجات کی ذریعه کیا جاتا ہے، لہذا یہ ایسا سامان ہے ،جس کی قیمت نقدی کے ذریعہ لگائی جاتی ہے نہ کہ ایسی نقدی کے زر یعہ سامان  کی قیمت لگائی جاتی ہے  .

فلوس کی مختصر  اسلامی  تاریخ .

کہا جاتا ہے کے فلوس سے قبل لوگ گندم وغیرہ بطور ثمن استعمال کرے تھے ،اس کے بعد تانبے وغیرہ کے فلوس رائج ہو گنے ...مراجعت کتب سے معلوم ھوتا ہے کہ حضرت عمررضیاللہ تعالیٰ عنہ نے ١٧ ہ میں "بازنطینی "طرز  پر بنایا ،یہ فلوس بلاد مصر یہ  میں پھیل گنے ،ان فلوس پر عربی حروف میں ان کا نام بھی درج تھا .اس کے بعد ایسے فلوس بنا ے گنے ،جن ڈھالے جانے کی تا ریخ اور مقام کا نام بھی درج ھوتا تھا،ان فلوس میں قدیم ترین فلوس ٩٠ہ کے ہیں .

ابو الفضل حنفی نے خراسان میں فلوس کو خوب رواج دیا ،چنا ں چہ وہ فلوس کے بارے میں کہتے ہیں . "هي فينا بمنزلة الفضة عندهم "  يعني فلوس ہمارے نزدیک  وہی حثیت رکھتے ہیں،جو ان کے چاندی ...اس زمانے  میں اسی زر سے معاملات ہونے لگے ،اور یکے بعد دیگرے بادشاہ فلوس بناتے رہے ،لیکن  ٦٥٠ہ میں لوگوں کے پاس فلوس بہت  زیادہ هو گنے .تقریبا  ٧٢٠ہ کے لگ بھگ امر محمود  نے قاہرہ میں فلوس ڈھالنے شروع کیے، اور دراہم کو ختم کر دیا ،اور فلوس ہی کو سونے اور دوسرے معاملات کا معیار قرار  دیا گیا،اب ایس کا مطالب یہ ھوا کہ اس زمانے میں فلوس ہی نیں اصل زر کی حثیت اختیا ر کر لی....چناں چہ٨٢٨ہ میں بادشاہ نے اعلان  کیا کیے فلوس میں ہر ر طل بارہ درہم کیے برابر ھو گا ،اس کیے بعد اس کی قیمت زیادہ ھو گئی،
اور یہ اعلان
  کیا گیا کہ ہر رطل  ١٨ درہم کا هو گا .(زر کا تحقیقی مطا لعہ...محولہ بالا  ماخذ)


لیث بن سعد(رح-م -١٧٠ ھ) کہتے ہیں: یحییٰ بن سعید (رح -م -١٤٣-ھ ) اور ربیعہ(رح -م-١٣٢ ھ ) سے مروی ہے کہ وہ فلوس کے ساتھ ادھار اور کمی بیشی کے ساتھ خریدوفروخت کو مکروہ سمجھتے تھے اور کہا کرتے تھے : فلوس سونے چاندی کی طرح نقود کی حیثیت اختیار کر چکے ہیں (خریدوفروخت-صفحہ-١٣٥)


امام مالک(رح-٩٣-١٧٩-ھ) نے فلوس کو درج ذیل دو شرطوں کے ساتھ نقود قرار دیا ہے :
١.ان پر شاہی مہر ثبت هو (٢) انہیں معاشرے میں  نقود اور ثمن کی حیثیت سے رواج حاصل هو .
امام مالک نے ایک موقع پر فلوس کو سامان بھی قرار دیا ہے، چنانچہ مدونہ کے مصنف لکھتے ہیں" میں نے پوچھا
: اگر میں آدھے درہم کے عوض فلوس اور باقی آدھے درہم کے عوض نصف درہم کے وزن کی بقدر چاندی خریدوں تو کیا امام مالک کی رائے میں یہ جائز ہے ؟ انہوں نے نے جواب میں کہا : چونکہ فلوس کی حیثیت سامان کی سی ہے اس لتے اس میں کوئی حرج نہیں -(المدونا ٤٠٣/٢).

چونکہ امام مالک نے بعض مواقع پر فلوس کو سامان بھی قرار دیا ہے،اس لنے یوں معلوم ھوتا ہے کے انہوں نے فلوس رائج اور متداول ہونے کی صورت  میں انہیں نقود قرار دے کر سونے چاندی کے ساتھ ان کی ادھار خریدوفروخت کو جو ممنوع قرار دیا ہے یہ صرف سد ذریع کے طور پر تھا. واللہ اعلم .(خریدوفروخت-١٢٣)

امام نووی (رح -م-  ٦٧٧ہ  ) کے نزدیک"فلوس" اگرچہ بعض شہروں میں ثمن کا درجہ رکھتے ہیں ،لیکن یہ ثمن کی جنس میں  سے نہیں ہیں .

فلوس جہاں صرف محدود علاقائی سطح پر معتبر سمجھے جاتے تھے وہاں ان کی قیمت بھی بہت معمولی ہوتی تھی ،جو ایک درہم کے اڑتالیسو ین حصہ سے زیادہ نہیں ہوتی تھی (النقود و استبدال العملات :ص-ع) اسی لیے انہیں صرف حقیر اشیا کے ثمن اور ریزگاری کے طور پر استعمال کیا جاتا تھا ،نیز اسی لیے انہیں محض ایسا سامان تجارت سمجھا جاتا  تھا جسے نقدی کے طور پر قبول کرنے پر کسی علاقے کے لوگ اتفاق کر لیتے ہیں، چنانچہ  تانبے اور لوہے کے سکے در حقیقت تانبے اور لوہے کے ٹکڑے ہوتے ہیں،جن میں محض ڈھلنے کی وجہ سے امتیازی شان پیدا هو گئی ہے ،جبکہ تانبا اور لوہا نقدی نہیں،بلکہ سامان ہیں تو ان سے بنے سکے بھی سامان کے حکم میں ہونے چاہیں(المدونة)
يہي وجه هے  إمام مالك نے فلوس کو سامان کے حکم میں قرار دیا ہے ،نیز ابن  عابدین(رح-     ) نے اپنے حاشیہ میں حنفیہ کا یہی مذھب نقل کیا ہے (حاشیہ ابن عابدین )


عقد صرف اور فلوس ،کے مباحث میں فقہاء کرم کی عبارا ت سے یہ بات اچّھی طرح واضح هو جاتی ہے کے اکثر فقہائے اسلام کے نزدیک فلوس ایسے نقود کی حثیت نہیں رکھتے ،جن پر عقد صرف  کے قواعد اور احکام کا اجراء ہوتا ہو،بلکہ ان  کے نزدیک ان کا حکم اس دھات والا ہے،جس سے یہ بنے ہیں. جن فقہاء کے نزدیک فلوس مال ربوی نہیں،ان کے نزدیک یہ سامان ہیں،نقود نہیں ،نیز وو انہیں موزو نی اشیا کی بجانے عددی اشیا میں شمار کرتہ ہیں یا پھر سا مان کے حکم  میں سمجھتے ہیں، اسی لیے ان کے نزدیک ان میں سود متحقق نہیں ہو سکتا ،کیونکہ  مالکیہ اور حنابلہ کے ایک قول  مطابق سونے اور چاندی میں سود کی علت ثمنیت اور باقی اصناف میں طعم (کھانے پینے کی اشیا میں سے ہونا )ہے .   


شافعیہ کے نزدیک نقدین میں سود کی علت ان کا حقیقتاّ ثمن ہونا(جو هرية الأ ثمان) اور دیگر أصناف میں طعم ہے.


جیسا کے پہلے بھی بیان ہو چکا ہے کہ حنفیہ میں سے صرف امام محمّد(رح-م-) نے اس بنیاد پر فلوس کو مطلقا مال ربوی قرار دیا ہے کے لوگوں کے ہاں اصطلاحی ثمن بن جا نے کی وجہ سے ان میں ثمنیت کا وصف غالب آ گیا ہے ،جبکہ   
شیخین نے فلوس کے مال ربوی ہونے کے لتے عدم تعيين کی قید لگایی ہے  ،کیوں کہ ان کہ نزدیک تعيين کہ بعد یہ ثمن نہں رہتے ،بلکہ سامان بن جاتےہیں.


حنابلہ میں سے بعض حضرت نے اگرچہ فلوس میں سود کی علت وزن اور ماپ کو قرار دیا ہے، لیکن اس کے باوجود ان کے ہاں اس بارے میں مختلف اقوال ملتے ہیں ،چنانچہ بعض حنابلہ نے اصل کے اعتبار سے موزو نی ہونے کی وجے سے فلوس کو مال ربوی قرار دی ہے ،لیکن انہوں نے بھی فلوس کی ثمنیت کو معتبر نہیں جانا، جبکہ دیگر بعض نے ان کے عددی ہونے کی بنیاد پر ان کے مال ربوی ہونے کا انکار کیا ہے ،لہذا اس را ے کے مطابق ان میں سود کی کوئی الٹ موجود نہیں (المغنی ابن قدامہ  ١٤٠/٤-بحوالہ خریدوفروخت).

مصنف "زر کا تحقیقی مطالعہ"لکھتے ہیں .--فلوس کے ثمن ہونے یا نہ ہونے میں اختلاف فقہاء-- 

فقہاے کرم کی عبارت کے تتبع  اور استقرا سے اور ان پر غور کرنے سے اس سلسلے میں تین اقوال سامنے آتے ہیں، جو درج زائل ہیں:-

١. حضرات حنفیہ میں سے امام محمد،محمّد بن الفضل، علامہ سرخسی ، علامہ حلوانی ،حضرت مالکیہ ، علامہ ابن تیمہہ ، اور اللہم ابن القیم(رح)، ان حضرا ت(رح) کا قول ہے کے فلوس اثمان ہیں.
٢. حضرات حنفیہ (رح) میں سے امام ابو حنیفہ ، امام ابو یوسف کے ہن فلوس کو ثمنیت  لازم نہیں اور متعین کرنے سے متعین  ہوتے ہیں، اور حضرت شا فیعہ کا قول یہ ہے کے فلوس اثمان نہیں .

٣. حضرات حنابلہ (رح )کی اس سلسلے میں دو رواتین ہیں ، ایک رویت یہ ہے کہ فلوس اثمان ہیں، یہی امام احمد بن حنبل (رح) سے  منصوص ہے، اور یہی ان کے ہاں راجح ہے ،اور دوسری روایت بعض حنابلہ علم کی ہے،اور وو یہ کہ فلوس اثمان نہیں ہیں ،گویا کے حنابلہ ایک روایت میں فریق اول کے ساتھ ہیں، اور دوسری روایت کے مطابق فریق سنی کے ساتھ ہیں.(دوکتور مولانا عصمت اللہ صاحب -ص١٢٥ -ادارہ المعارف کراچی )

میری راے میں ایسی صورت حا ل میں جبکہ فلوس ہی معروف نقود کی حثیت اختیار  کر چکے ہوں  اور رواج میں سونے چاندی کے مشابہ ہو چکے ہوں ، بلکہ مقریزی کے بقول  ،چاندی کے غائب ہونے کے بعد اس کی جگہ لے چکے ہوں تو ان پر نقدین (سونے چاندی) کے احکام جاری نہ کرنا شریعت کی دو
ا درج زیل اہم ترین احکام کو معطل کرنے کے مترادف ہو گا .

١. زکاة الله تعالى نے أموال میں  واجب قرار دیا ہے، چنانچہ اللہ تعالیٰ کا ارشاد ہے، " اور جن کے ما لوں میں حصہ مقرر ہے-(یعنی )مانگنے والے اور نہ مانگنے والے کا" اور نقود بھی اموال ہیں -

سود- شافعیہ نے اس کی علت اگرچہ کسی چیز کی حقیقت کے اعتبار سے ثمن ہونے(جوهرىة  الاثمان ) کو قرار دیا ہے، لیکن فلوس چونکہ نقدین(سونے، چاندی) کے قائم مقام ہو گیے ہیں ، اس لیے یہ محض تانبا ہونے کی حیثیت سے نکل کر نقدی کی حثیت اختیار کر گیے ہیں، نیز امام الحرمین نیں چونکہ سونے چاندی کا مقصد نقدیت کو قرار دیا ہے ، اس لیے قیاس مشا بہت 
کی بنیاد پر فلوس کو سونے چاندی کے ساتھ ملحق کیا جا نے گا...بلکہ بعض اوقات تو نقدی ہونے کی حیثیت سے فلوس کا استعمال سونے چاندی سے بھی بڑھ جا تا ہے -والله أعلم .


ڈاکٹر محمد توفيق رمضان البوطي مندرجہ بالا مضمون کے سسلے پر تبصرہ کرتے ہونے لکھتے ہیں کہ - شائد میرا یہ کہنا قبل از وقت ہو کی فقہا  نے فلوس کا جو مفہوم بیان کیا ہے، آج کل ام طور پر اس مفہوم میں فلوس استعمال نہیں ہوتے، لیکن گزشتہ تحقیق کی روشنی میں،میں اس نتیجے پر پہنچا ہوں ہوں کے ام طور پر فلوس صرف کم قیمت اشیا کے ثمن کے طور پر استمال ہوتے تھے، جن کی عرفی حثیت تو تھی ،لیکن ذاتی حیثیت تانبا ہونے سے زیادہ نہ تھی.ان کی قیمت کا مدار دو چیزوں پر تھا:(١)تانبے کی حثیت سے وزن (٢) ڈھلائی کے اخراجات .

اس ڈ ھلائی کی بدولت انہیں محدود پیمانے پر عرفی ثمن کی حثیت سے استعمال کیا جاتا تھا،لیکن جب فلوس نے سرکاری اعتبار کی وجہ سے ،قطع نظر اس کے مفاسد اور برے نتائج کے نقد کی صورت اختیار کر لی تو فقہاء نے وصف ثمنیت کے غلبہ کی وجہ سے ع پر سود کے احکام جاری کرنا شروع کر دینے،خاص طور پر جب ان کا استعمال اتنا عام ہو گیا کھ سونے  چاندی کا بھی ان جیسا رواج نہ رہ، چنانچہ جب خراسان میں فلوس رائج ہو گے تو حنفیہ اور ما لکیہ نے یہی ری اختیار کر لی، حنابلہ کی ایک رویت بھی اس کے مطابق ہے (منتهي الارادات ،فتح القدير، حاشية ابن عابدين)
نیز  فقہاء،شافعیہ نے اور ابن ہجر نے اپنے فتاویٰ میں اس کی تصریح کی ہے (ال مجموع -نووی ، ال-فتویٰ الکبریٰ ابن حجر )
It is important to mention here that the in the early days of Islam the fulus were used for small exchange of goods and transaction but after that they had been struck in abundance. According to the statement of Maqraizi( R-A ...d-845 A.H),these fulus had driven out the full-bodied money and taken place the gold and silver. Maqraizi, ill felt it. He criticized on such a situation. He said that in the known history of the world ,no thing had been seen  which had been been used for a source of exchange for smallest things, and  had not been declared as naqud(money) or equal to the status of naqud of gold and silver. In these days  , the foreigners came in Egypt carrying the raw copper for striking the fulus. Hence they struck fulus up  to the extent that they driven out the full-bodied money from the Egypt and fulus had taken the place of actual money of gold and silver. According to him-this story is very painful, sham-full and is cause of loss. There are some other similar statement  found in the history where the BAD MONEY DRIVES OUT GOOD. See the under noted Gresham,s law. 

Enunciates the law the"bad money drives out good". If two coins have the same nominal value but are made from metals of unequal value, the cheaper will tend to drive the other out of circulation. Sir Thomas Gresham, financial agent of Queen Elizabeth I, was not the first to recognize this monetary principle, but his elucidation of it 1558 prompted the economist H.D. Macleod to suggest the term"Gresham's law" in the 19th century. Money functions in ways other than as a domestic medium of exchange; it also may be used for foreign exchange, as a commodity, or as a store of value. If a particular kind of money is worth more in one of these other functions, it will be used to buy foreign exchange or will be hoarded rather than used for domestic transactions. For example, during the period from 1792 to 1834 the United States maintained an exchange ratio between silver and gold of 15:1, while the ratios in European countries ranged from 15.5:1 to 16.o6:1. This made it profitable for owners of gold to sell their gold in the European market and take their silver to the United States mint. The effect was that gold was withdrawn from domestic circulation; the"inferior" money had driven it out.

مصنف تاریخ مبارک  شاہی لکھتا ہے کہ، سلطنت کے اخراجات پورے کرنے کیلے ،سلطان محمّد شاہ نے آٹھویں صدی ہجری میں، خزانہ کی کمی کو پورا کرنے کے لنے (سونے کی بجا ے) تانبے کی مہریں (سکّہ رائج الوقت کے طور پر جاری کرنے ) کا حکم صادر کیا اور اس کا نرخ بیس پنجگانی اور موجودہ ایک ٹنکہ کے مساوی نرخ مقرر کیا -جو شخص اس (تانبے کی) مہر کو قبول کرنے میں حیل و حجت کرتا تھا سزا پتا تھا. دیہات کے ہندووں اور مفسدوں نے  قصبات کے لوگوں کی دیکھا دیکھی اور ان کی مدد  سے گاؤں گاؤں سکوک بنانےکے مرکز قائم کر لیے اور دھڑا دھڑ تانبے کے سکّے  ڈھال ڈھال کر شہروں میں بھیجنے اور ان کے بدلے میں سونا ،چاندی، گھوڑے ، ہتھیار اور دیگر قیمتی اشیا خریدنے لگے ...مختصر یہ کہ جلد ہی دور و دراز کے لوگ تانبے کے سکے لینے سے انکار کرنے لگے اور سونے کے ایک ٹنکے کی قیمت تانبے کے پچاس ساٹھ ،ٹنکوں تاک پہنچ گئی.جب اس نے اس سکے کی کساد بازاری دیکھی تو مجبور ہو کر اس کو منسوخ قرار دے دیا اور حکم جاری کیا کہ جس کسی کے گھر میں تانبے کے ٹنکے ھوں لے آنے اور  اس کے عوض شاہی خزانے سے سونے کے ٹانکے لے جاۓ. اس طرح سے تانبے کے سکوں کے بدلے میں سونے کے ٹانکے خزانہ شاہی سے لے جا کر لوگ امیر ہو گنے  اور وو تانبے کے ٹنکے جو لوٹانے گنے(اتنی بڑی تعداد میں تھے کی ان سے) قصر تغلق آباد میں بڑے بڑے ڈھیر سے لگ گنے . 

The writer of History of Mubarik Shahi ,has mentioned that in the days of Sultan Muhamad Shah(r.725 A.H), the full bodied money become short(Forfeiture-Kassad -Inqta'a) due to lavishly expenditures of the Ruler at that time and he issued a firman(fiat) that the currency may be mad with copper etc instead of gold and silver. The opportunists/Imitators and criminals had made the fake currency with copper and purchased so many valuables along with the coins of silver and gold. The value of the copper coins had been decreased considerably,but in fact the people were not accepting the currency made out of copper. The ruler of the sub continent had been forced to recall his fiat/firman along with the order that the owners of the copper coins may be got changed with the coins of gold and silver. The opportunistic had earned very much.

From the above table, the following important observations can  immediately be noted.

1. Evidently, it is the fulus which can rightly be designated as the one which has evolved in the form of paper money. In particular, the three critical features of modern money, namely its fiat character, abundant supplies and uncertain purchasing power/exchange rate,were shared only be fulus.

2.In the process of evolution, the paper currency has shed all those defects that made the fulus a somewhat imperfect money. In particular, the problems of poor store of value, unsuitable mode for deferred payments or investments, lack of standardization, difficulty in recognition and lack of durability were overcome by the paper money. More than overcoming these defects, the biggest advance was made in the creation of an institutional frame work which was completely missing under the old system, but which is the single mostly important reason behind giving the paper money its fiat character and widespread acceptability and confidence for use in transactions.Al though there continue to remain many institutions which supply paper currency, there is a national agency everywhere in the world called the Central Bank, which has been mandated to control and oversee the functioning of the monetary system based on paper money. The existence of such an institution may alone explain the differences in the acceptability of fulus and paper  money.

3.It will be noted that the paper currency is not simply fulus but it has embodied all those traits that made gold and silver more respectable and accepted media in the realm of currencies. In fact, it has gone beyond them, freeing the exchange from the need of such metals. Curiously, at the end of the evolution of paper currency, this position has been achieved with absolutely no reference to values of gold and silver determining the value of paper currency, although it was thought that paper currency would not survive unless it remains to be the representative of a suitable metal.

4.Although there as some misunderstanding in the beginning, it is now an established position of the fuqha, that paper currency falls within the definition of nuqud, i.e gold and silver, and fulus over which zakat is levi-able.

5. More generally, all those principles of shara,ah which are applicable on nuqud, will be applicable on paper currency. In particular, it will attract the injunctions relating to riba.(Ref:-Transition to a Riba free economy-I.I.I.T--IIUI, Islamabad)

CONCLUSION. From the above discussion and information it is concluded that, at the advent of Islam the Gold and silver and their coin were being used for transaction in sale and purchase etc, but for smallest transaction the eggs, wheat etc was being used and side by side the fulus and divided pieces of the gold and silver were being used. After that the fulus were struck up to use for small exchanges. Further, the fulus had taken the place of full-bodied monies and they driven out the superior monies, keeping in view the statement of Maqraizi (r.a) the scholar in Egypt in 8th Hijrah century. The  earlier scholars of the Islam had accepted the monies other than gold and silver with disapproval, and their acceptance as nuqud,  was due to  the reasons that the commands of the Lawgiver may not been suspended regrading Zakah and Riba. In these days the currencies which had the intrinsic value were the monies/nuqud. The Islamic world has ,perhaps compromised  in connection with the acceptance  of other monies  fulus and paper or like these.as nuqud(Monies).
